The 2026 enforcement stack hits in two steps — SchwarzArbMoDiG modernises FKS authority on 1 January, the Mindestlohn-Bau LG2/LG3 floors converge East–West on 1 April. SOKA-BAU and §14 AEntG run continuously throughout.

  1. 1 January 2026

    SchwarzArbMoDiG in Kraft

    Finanzkontrolle Schwarzarbeit becomes a 'kleine Staatsanwaltschaft' with independent §266a StGB investigation authority, mandatory live access to payroll IT, biometric on-site identity capture and automated cross-matching across A1, DRV, Meldeportal-Mindestlohn and Landesfinanzbehörden.

  2. 1 January 2026

    Mindestlohn-Anhebung €13.90

    Statutory minimum lifted +8.42% — the largest single-step increase in gMiLoG history. Buffers built into 2024–2025 deployment budgets evaporate.

  3. 1 April 2026

    Mindestlohn-Bau LG2/LG3 step

    Tarifvertrag floors converge East–West. LG1 federal floor €13.95, Fachwerker LG2 €17.05, Spezialbau-Facharbeiter LG3 €23.97 — allgemeinverbindlich under §3 AEntG, binding on every posted crew regardless of employer seat.

  4. Continuous, 2026

    SOKA-BAU + GU-Bürgenhaftung

    Urlaubskasse 15.1% + Berufsbildung 1.9% + Zusatzversorgung 3.2% on every construction worker. §14 AEntG imposes no-fault guarantor liability across the entire Nachunternehmer chain under established BAG case law on Generalunternehmerhaftung.

50,000 annual §26 Abs. 2 BeschV quota — doubled by Federal Cabinet effective 1 June 2024 and in force through 2026 — worked alongside the India and Gulf corridor for trades where the Eastern-European posted-worker pool is exhausted. Anerkennungspartnerschaft under §16d AufenthG pre-initiated with HWK/IHK before deployment.
