AKÜ-Bau Auftraggeberhaftung 40%
Betrugsbekämpfungsgesetz 2025 lifts the §67a ASVG Auftraggeberhaftung in Arbeitskräfteüberlassung Bau from 25% (20% SV + 5% Lohnabgaben) to 40% (32% SV + 8% Lohnabgaben) of Werklohn. Werkvertrag constellations remain at 25%; the Werkvertrag/AKÜ demarcation becomes the audit focal point.

LSD-BG novella — Kumulationsprinzip aufgehoben
Novelle des LSD-BG (BGBl I 2024) abolishes the Kumulationsprinzip for Unterentlohnung and Formaldelikte — penalties are levied per case, not per affected worker. Minimum penalties removed; new ceiling €400,000 for vorsätzliche Vorenthaltung >50%.
