Belgium: 2024 → 2026 Timeline

The Sociaal Strafwetboek reform of 1 July 2024 took effect; the 1 January 2025 hoofdaannemer documentation duty added written illegal-employment clauses and L1-receipt + A1 retention; the 1 February 2026 x10 multiplier and 1 May 2026 self-employed inhoudingsplicht extension reshape exposure simultaneously.

  1. 1 July 2024

    Sociaal Strafwetboek hervorming

    Revised Social Penal Code in force. Late LIMOSA renewal explicitly punishable as Level 4. Fines multiplied by number of affected workers (capped at 100). Aggravating-factor floor: criminal Level-4 fine ≥ €35,000.

  2. 1 January 2025

    Hoofdaannemer documentation duty + subcontracting cap

    The hoofdaannemer must obtain from every direct onderaannemer the L1-form (Limosa receipt) and the A1-certificate (or proof of A1 application). A written clause confirming no illegal third-country employment becomes mandatory. Entire-service subcontracting prohibited in construction.

  3. 1 February 2026

    Sociaal Strafwetboek ×10 multiplier

    Statutory multiplier on Social Penal Code fines raised from ×8 to ×10 for offences from 1 February 2026. Level-4 criminal fine for legal entities: minimum €30,000, maximum €720,000 — multiplied per affected worker up to 100.

  4. 1 May 2026

    Art. 30bis/30ter inhouding extended to self-employed

    The withholding regime extends to unpaid RSVZ contributions of self-employed (sub)contractors above the €2,500 indexed threshold. Combined ceiling: 35% RSZ, 15% FOD Financiën, 15% RSVZ — 50% of invoice excl. VAT. checkinhoudingsplicht.be portal live from 1 May 2026.

Every cross-border worker priced against PC 124 Categorie I (helper €17.15/h), Categorie II (skilled €18.70/h), Categorie III (gecertificeerd specialist €20.10/h) and Categorie IV at January 2026 indexation; team-leaders III/IV +10%. Quarterly health-index indexering (+0.21859% from 1 Jan 2026) tracked, not reconstructed.

LIMOSA + Check-in-at-Work + A1 stack

Each posted worker filed on the LIMOSA portal before work begins (L1-receipt produced to the Belgian opdrachtgever pre-arrival). Aanwezigheidsregistratie / Check-in-at-Work registered electronically on every werf ≥ €500,000 excl. VAT. A1 obtained or application logged before deployment. Up to 20 locations consolidated per Limosa under the 2024 enhancement.

Constructiv FBZ-FSE + RSZ onboarding

Constructiv registration triggered before site presence: 9.12% globale bijdrage (9% fidelity stamp + 0.12% supplementary), bad-weather stamp layered on gross wages per quarter. ConstruBadge (€20 per worker) issued before first werf entry. RSZ/ONSS employer envelope configured at mobilisation.

Sociale-balie defensible evidence pack

Every deployed worker arrives with the documentary anchor a Sociale Inspectie / SIOD raid would request — L1-form, A1, PC 124 loonbarema trace, SEPA-traceable remuneration, arbeidstijden timesheets, accommodation proof, Belgian-language contract clause on illegal employment. Designed to survive the 2025–2026 Plan Sociale Fraude inspection posture.

Single Permit corridor + India/Gulf intake

Single Permit (combined work-and-residence, regional competence) for non-EU construction workers — 4-month legal time, ~14-week real time. EU Blue Card 2026: Flanders €63,586, Wallonia €68,815, Brussels €56,976. Construction trades on the Flanders 2026 knelpuntberoepenlijst (21 occupations) and the Wallonia 2026 list (56 occupations) — bricklayers, concrete workers, roofers, welders, HVAC — receive priority routing.
