10. Operational Warnings & Red Flags
- The Maler / Trockenbauer split is the primary compliance trap for finishing subcontractors. The most common violation discovered by Zoll inspectors is a Maler (painter) classified and paid as a Trockenbauer helper to circumvent the sector minimum wage. Penalties exceed €500,000 per company.
- Fire board installation errors (GKB vs GKF) create long-tail liability. Building inspectors and insurers audit fire protection drywall up to 10 years post-completion. Errors discovered after wall closure require demolition and reinstatement at full contractor expense.
- System product warranties are voided by non-system installation. Knauf, Rigips, and Saint-Gobain warranties require that system components (tracks, boards, insulation) are used in specified combinations. Using competitor products in a warranted system invalidates the warranty — and the contractor’s liability protection.
- Piece-rate (Akkord) contracts in finishing are high-risk without Q-level specification. Workers maximising output on piece rate produce Q1–Q2 when Q3 was specified. Disputes are difficult to resolve after painting. Specify Q-level in the subcontract and retain GC sign-off at intermediate stage.
- VOC regulations (Biozidverordnung) affect product selection for biocidal coatings. Facade paints with algaecide or fungicide content must comply with EU 528/2012. Using non-compliant products creates product liability exposure regardless of workmanship quality.
- Soka-Bau targets finishing subcontractor chains. Polish, Romanian, and Ukrainian finishing teams operating under multi-layer subcontracting arrangements are a Soka-Bau enforcement priority. Documentation must be immediately producible on-site.
Trade-specific context
Inhalation hazards. Gypsum dust from sanding jointed seams; the IARC has reviewed crystalline silica (present in some gypsum and most plaster compounds) as Group 1 carcinogen. Solvent-based paint releases VOCs; spray application produces aerosolised droplets. Required: FFP2 minimum for sanding, FFP3 plus organic-vapour cartridge for solvent spray, mechanical ventilation in enclosed fitout zones.
Working at height. Ceiling installation, taping at high level, and rolling stock-paint coverage all routinely take operatives above 2 m. Mobile elevating work platforms (MEWPs) and tower scaffold are standard. Operators must hold IPAF PAL card (or national equivalent — DGUV, AFOCAL) and PASMA for tower scaffold. Eye and skin. Splash from wet paint, primer, and joint compound; sander-borne particulate; solvent contact dermatitis. Sealed safety glasses, nitrile gloves, and barrier cream are baseline.
Musculoskeletal. Repetitive overhead work for ceiling installation and tape-and-joint produces shoulder impingement and lower-back loading. Operatives report cumulative MSK injury rates above the construction-sector mean. Knee pads required for floor-level paint and skim-prep work.
Chemical handling. Two-pack epoxy systems (floor coatings, anti-microbial wall systems) present isocyanate exposure risk where polyurethane is involved. Health surveillance under host-state OSH regime (DGUV in DE, INRS in FR, RIVM in NL) is mandatory for operatives handling isocyanate-containing products.
Required PPE matrix: FFP2/FFP3 dust mask, organic-vapour respirator for solvent work, sealed eye protection, nitrile gloves, knee pads, paint-suit coverall, safety footwear S3, hard hat for shared site zones. Compliant with EN 149 (respirators), EN 166 (eye protection), EN 388 (gloves), EN ISO 20345 (footwear).

Maximum duration: Default 12 months under Directive 2018/957; extendible to 18 months upon motivated declaration to the receiving authority. Beyond 18 months, the host-state labour-law regime (excluding pension and supplementary pension) applies fully (so-called “long-term posting”).

A1 portable document: Under Regulation (EC) 883/2004 and implementing Regulation 987/2009, posted workers retain home-state social-security coverage subject to issuance of the A1 PD by the home Member State. A1 must be available on site at all times; field inspections by Finanzkontrolle Schwarzarbeit (FKS) routinely verify it. Maximum posting under Article 12 of 883/2004 is 24 months.

Wage-parity rule: AEntG declares specified collective agreements universally binding (Allgemeinverbindlich); for the construction main sector, the Bundesrahmentarifvertrag-Bau (BRTV-Bau) and the Tarifvertrag Mindestlohn Bau apply. Posted workers must receive the AEntG-extended minimum wage corresponding to their Lohngruppe, plus statutory leave (30 working days) and Soka-Bau contributions paid by the employer.

Sanctions: Under §23 AEntG and §21 MiLoG, fines for underpayment, missing notification, or failure to keep records reach EUR 500,000 per case. FKS published 2024 figures recording approximately EUR 50 million in MiLoG-related fines and over 2,500 final criminal sanctions in construction-sector cases. The 2018 Bayrische Bau case (Generalzolldirektion ref. unpublished) saw a EUR 300,000 fine imposed on a Polish posting employer for systematic Soka-Bau evasion.
