Social Security Coverage

10. Operational Warnings & Red Flags

  • ZKO-Meldung must precede first day of work, not coincide with it: Unlike some neighbouring jurisdictions where same-day notification is tolerated, §19 LSD-BG is strict. The ZKO-3 / ZKO-4 must be lodged through zko.bmaw.gv.at in German before the worker enters the site. Each material change — site relocation, extended duration, additional worker — triggers a fresh notification. Finanzpolizei treats “no ZKO at site visit” as a strong-evidence case.
  • Befähigungsnachweis is firm-level, not worker-level: The most common operational misunderstanding. A worker deployed for Maurer- und Betonbauer work does not personally need a Befähigungsnachweis; the qualification attaches to the legal person. The corollary is that an unqualified firm cannot legalise its activity by employing qualified workers — the firm-level qualification is the bottleneck.
  • BUAK applies even on short postings — no de minimis threshold: Posters with prior Soka-Bau or Constructiv experience often expect reciprocity. Only formally listed §33d equivalences discharge the obligation, and the list is short (Soka-Bau Germany, Constructiv Belgium, Stichting Vakantiefonds Bouw Netherlands). The 13.45 per cent overhead is routinely under-priced on week- or month-scale deployments.
  • Verwendungsgruppe misclassification is treated as wage underpayment: Assigning a qualified Facharbeiter to Verwendungsgruppe IV (Bauhandwerker) instead of III triggers §29 LSD-BG proceedings. KV-classification literacy is not optional; the gap between III and IV runs roughly EUR 1.20/hour, which compounds across overtime and Sonderzahlungen.
  • Auftraggeber-Solidarhaftung makes the principal the de facto enforcer: Under §67a ASVG and the AGH, the Generalunternehmer is jointly and severally liable for sub-contractor ASVG contributions and KV wage shortfalls. Major Austrian principals (Strabag, Porr, Habau, Swietelsky) screen sub-contractor and worker-leasing chains through HFU verification as standard procurement practice.

Trade-specific context

Respirable crystalline silica (RCS) dust is the dominant occupational exposure risk across all 29 jurisdictions. EU Carcinogens and Mutagens Directive 2017/2398 set a binding 0.1 mg/m³ 8-hour TWA limit, transposed nationally with stricter values in DE (TRGS 559: 0.05 mg/m³), NL (Arbobesluit 4.19: 0.075 mg/m³ [verify]), FR (Code du Travail R.4412-149), and IE (SI 622/2001 as amended). Wet-cutting and on-tool LEV (local exhaust ventilation, vacuum extraction with H/M-class filtration) are non-negotiable on EU sites since the 2019 Directive transposition deadline. CEN reference: EN 12779 (woodworking dust) is sometimes cited by analogy, but masonry-specific guidance falls under national authorities (HSE COSHH, BAuA TRGS 559 https://www.baua.de/, INRS ED 6451).

Manual handling: Brick and block weight thresholds are jurisdictionally set. MSK injury from repetitive masonry motion is the largest long-term morbidity driver — knee bursitis, shoulder impingement, lumbar disc degeneration. Rotation between coursework and labouring tasks reduces incidence.
